Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BaySync web and mobile applications (the "Service") provided by HaulDesk Inc. ("we", "us", or "our"). By accessing or using the Service, you agree to these Terms.

1. The Service

BaySync is workplace software that helps auto repair shops manage work orders, vehicle records, inspections, inventory, and employee time. The Service is intended for business use by shops and their authorized employees.

2. Accounts

Accounts are created and managed by the shop that subscribes to the Service. The shop is responsible for authorizing its users, assigning roles and permissions, and for the activity that occurs under its accounts. You are responsible for keeping your login credentials confidential and for all activity under your account.

3. Acceptable Use

When using the Service, you agree not to:
  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorized access to the Service, other accounts, or shop data that does not belong to you.
  • Interfere with, disrupt, or attempt to reverse engineer the Service.
  • Upload content that you do not have the right to share or that infringes the rights of others.

4. Your Content

You and your shop retain ownership of the work orders, records, photos, and other content you submit to the Service. You grant us the limited rights necessary to host, process, and display that content for the purpose of operating the Service.

5. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we handle information collected through the Service.

6. Subscription and Fees

Access to the Service may require a paid subscription arranged between your shop and us. Fees, billing terms, and plan details are as agreed at the time of purchase.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

8. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits arising out of or related to your use of the Service.

9. Termination

We may suspend or terminate access to the Service if these Terms are violated or if necessary to protect the Service or its users. You or your shop may stop using the Service at any time.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
